This Privacy Policy describes how AI SmartTalk, operated by Odran HUSSON and Pierre-Antoine Caillaud, collects, uses, and shares information about you when you use our website located at https://aismarttalk.tech/ and the services provided through it.

Information We Collect

Information You Provide to Us:

  • Single Sign-On (SSO) Providers Information: We collect information from your SSO provider when you use it to sign into our platform. This typically includes your name, email address, and any other information shared by your SSO provider.
  • Billing Information: While we do not store credit card details (as we use Stripe for payment processing), we collect necessary billing information such as your name, billing address, and transaction details for subscription purchases and renewals.

Information We Automatically Collect:

  • Usage Data: Information on how you interact with our services, which may include dates and times of access, features or pages viewed, and other system activity.
  • Technical Data: We may collect technical information about your device, including IP address, operating system, browser type, and other information for improving our services and ensuring a secure environment.

Legal Basis for Processing (GDPR)

We process your personal data on the following legal bases:

  • Contract performance: To provide our services, manage your account, and process payments;
  • Legitimate interest: To improve our services, ensure security, and prevent fraud;
  • Consent: When you select a non-EU AI model, enable push notifications, or subscribe to promotional communications;
  • Legal obligation: To comply with applicable laws and regulations.

How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our services;
  • Process transactions and send related information, including confirmations, invoices, and customer experience surveys;
  • Send technical notices, updates, security alerts, and support messages;
  • Respond to comments, questions, and customer service requests;
  • Communicate about products, services, offers, promotions, and provide news and information we think will be of interest to you (from which you can opt-out at any time);
  • Monitor and analyze trends, usage, and activities in connection with our services;
  • Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of AI SmartTalk and others.

Third-Party AI Model Providers

AI SmartTalk offers a default selection of AI models hosted within the European Union ("EU Sovereign Models"). These models process your data exclusively within the EU, in compliance with GDPR.

As an administrator, you may choose to switch to AI models provided by third-party providers located outside the European Union, such as OpenAI (United States), Anthropic (United States), or other non-EU providers. By selecting a non-EU AI model, you acknowledge and accept that:

  • Your conversational data (messages, documents, and any content shared with the assistant) will be transmitted to and processed by the selected third-party provider's servers, which may be located outside the European Union;
  • The processing of your data by these third-party providers is governed by their own privacy policies and terms of service;
  • AI SmartTalk cannot guarantee the same level of data protection as required under EU regulations (GDPR) once data is transferred to non-EU providers;
  • You are responsible for reviewing the privacy policy of the selected AI provider before enabling it.

A consent confirmation is required within the application each time you select a non-EU AI model. You may revert to an EU Sovereign Model at any time from your assistant settings.

Sharing of Information

We may share information about you as follows:

  • With third-party AI model providers when you explicitly select a non-EU AI model (see "Third-Party AI Model Providers" above);
  • With vendors, consultants, and other service providers who need access to such information to carry out work on our behalf, such as Stripe for payment processing;
  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process;
  • If we believe your actions are inconsistent with our user agreements or policies, to protect the rights, property, and safety of AI SmartTalk or others;
  • In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company;
  • Between and among AI SmartTalk and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
  • With your consent or at your direction.

Data Retention

We retain your personal data for as long as your account is active or as needed to provide you our services. Conversation data associated with your assistants is retained until you delete the assistant or your account. If you request account deletion, your data will be permanently removed after a 30-day grace period (see "Account Deletion" below).

We may retain certain information as required by law or for legitimate business purposes, such as fraud prevention or dispute resolution.

Account Deletion

You may request the deletion of your account at any time from the application settings (Settings > Danger Zone). Upon request:

  • Your account will be scheduled for deletion after a 30-day grace period;
  • During this grace period, you may cancel the deletion request and restore your account;
  • After the grace period, all your personal data, conversations, and assistant configurations will be permanently and irreversibly deleted;
  • If you are the sole administrator of an assistant, you may delete it individually before deleting your account.

Security

We take reasonable measures to help protect information about you from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction.

Your Choices

Account Information

You may update or correct information about you at any time by logging into your online account or emailing us at contact@aismarttalk.tech.

Apple Sign-In and Private Email Relay

If you sign in using Apple and choose "Hide My Email", Apple generates a unique private relay address. We treat this relay address like any other email address. We do not attempt to reverse or identify your real email address. You can manage email forwarding preferences directly from your Apple Account settings.

Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies.

Promotional Communications

You can opt out of receiving promotional emails from AI SmartTalk by following the unsubscribe instructions in those emails. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.

Your Rights Under GDPR

If you are located in the European Economic Area (EEA), you have the following rights regarding your personal data:

  • Right of access: You may request a copy of the personal data we hold about you;
  • Right to rectification: You may request correction of inaccurate or incomplete data;
  • Right to erasure: You may request deletion of your personal data (see "Account Deletion" above);
  • Right to data portability: You may request a copy of your data in a structured, machine-readable format;
  • Right to restrict processing: You may request that we limit how we use your data;
  • Right to object: You may object to our processing of your data based on legitimate interests;
  • Right to withdraw consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.

Children's Privacy

AI SmartTalk is not intended for use by children under the age of 16. We do not knowingly collect personal data from children under 16. If we become aware that we have collected personal data from a child under 16, we will take steps to delete that information promptly. If you believe a child under 16 has provided us with personal data, please contact us at contact@aismarttalk.tech.

International Data Transfers

Your data is primarily stored and processed within the European Union. When you select a non-EU AI model (see "Third-Party AI Model Providers"), your conversational data may be transferred outside the EU. In all other cases, we ensure your data remains within the EU or is transferred only to countries that provide an adequate level of data protection as recognized by the European Commission.
